Terms of Use Gift Card InCalabria

1. Definitions

“Gift Card” or “Card” refers to the digital voucher issued by the “Issuer”, namely InCalabria (Bearound by Emanuel Romeo, VAT number 03299910806), identified by a unique code, having a preloaded value in euros. “Site” refers to incalabria.net and related domains.

2. Legal Nature

The Gift Card is a multi-purpose voucher (BCMU) under the current VAT regulations (implementation of Dir. EU 2016/1065). VAT is applied at the time of use of the goods/services purchased with the Gift Card.

3. Issuance and Delivery

The Gift Cards are issued in digital format (PDF/code) and sent via email to the buyer specified at the time of purchase.

4. Value, Currencies, Reloads

The Gift Cards are denominated in euros and available in predefined amounts (€30/50/80/130). They are not reloadable.

5. Use and Balance

• The Gift Card can be used for the purchase of experiences/stays available on the Site until the credit is exhausted.

• Partial use is allowed on multiple transactions; the remaining balance remains active.

• If the price exceeds the balance, the difference is to be paid using methods available on the Site.

• It is not possible to combine multiple Gift Cards in the same order.

• The Gift Card cannot be used to purchase other Gift Cards.

• In the event of a refund of an order paid with a Gift Card, the refundable amount will be credited back to the same Gift Card; any additional payments made by card are refunded to the original method, according to applicable policies.

6. Expiration

The Gift Cards do not expire. In case of changes in platform/technology, the Issuer will guarantee full use of the credit (possible replacement of the code with equivalent value).

7. Loss, Theft, Unauthorized Use

The Gift Card is a bearer title digital: keep it safe. The Issuer is not responsible for misuse after delivery. In case of loss/theft, contact assistance immediately: if technically possible and upon verification of the buyer's identity, the code may be blocked and the unused remaining balance reissued. In cases of fraud or anomalies, the Issuer may suspend or cancel the Gift Card.

8. Right of Withdrawal (Distance Purchases)

For Gift Cards not yet used (even partially), the consumer buyer has the right of withdrawal within 14 days from purchase, with a refund to the original payment method. The withdrawal is no longer exercisable after the first use, total or partial, or for Gift Cards purchased at physical retail points different from the Site, unless otherwise stipulated by the merchant. To exercise the withdrawal: send communication to info@incalabria.net indicating order number and Gift Card code.

9. Refunds and Non-convertibility

The Gift Card is not convertible into cash and does not entitle to cash change. Except for withdrawal under art. 8, the loaded amounts are non-refundable.

10. Suspension/Termination of Service

In the case of cessation of activity or permanent impossibility to provide the services, the Issuer will ensure that holders have a mechanism for refund of remaining balance or equivalent use for at least 12 months from the official communication.

11. Personal Data

The processing of data is carried out according to the Site's Privacy Policy. Dedication and sender are used solely for the delivery of the Gift Card to the recipient.

12. Abuses and Reselling

Unauthorized resale of Gift Cards is prohibited. The Issuer may refuse suspicious orders (e.g. for fraud, money laundering, or violation of the law).

13. Applicable Law and Jurisdiction

These Terms are governed by Italian law. Competent court: that of the consumer in the cases provided; otherwise, the court of Reggio di Calabria. 

14. Changes to the Terms

The Issuer may modify the Terms for regulatory/technical adjustments. The changes do not affect the rights already accrued; existing balances remain valid.
